Monthly Self Storage Agreement


Note: These Terms and Conditions are accepted during customer sign-up.
You must read these carefully before storing your goods.
By signing up, making payment, and moving your contents into Loc It Up, you are accepting these Terms and Conditions.

KEY POINTS
  • Contract Type: This is a monthly recurring contract that runs continuously until cancelled.
  • Notice Period: Notice can be provided at any time. No further charges are made after notice is provided, and the Customer will have access to their unit until 11:00pm on the one-month anniversary of their last payment.
  • Ownership: The Customer owns or is authorised to store the goods.
  • Payment: Storage fees must be paid in advance and on time.
  • Default: If you fail to comply with the conditions of this agreement, Loc It Up has certain rights which include the right to cancel access to your unit, seize, sell, and/or dispose of your goods.
  • Security: The Customer must keep the unit secure.
  • Prohibited Items: The Customer must not store hazardous, dangerous, illegal, stolen, perishable, environmentally harmful, or explosive goods.
  • Suitability: The Customer must check the unit is suitable for storing the goods.
  • Liability: Loc It Up’s liability for loss of or damage to goods is limited to £100.
  • Insurance: Goods are stored at your sole risk. You must take out insurance cover.
  • Privacy: Loc It Up may use and share your personal and other data in accordance with UK data protection laws.
CONDITIONS OF AGREEMENT
STORAGE
  1. So long as all fees are paid up to date, the Customer:
     (a) is licensed to store goods in the unit allocated by Loc It Up from time to time and only in that unit;
     (b) is deemed to have knowledge of the goods in the unit; and
     (c) warrants that they are the owner of the goods in the unit and/or entitled at law to deal with them in accordance with all aspects of this agreement as agent for the owner.
  2. Loc It Up:
     (a) does not have and will not be deemed to have knowledge of the goods;
     (b) is not a bailee, custodian, or warehouseman of the goods;
     (c) does not grant any lease or tenancy of the unit; and
     (d) provides unit sizes that are approximate and may vary slightly from those described. By signing this agreement, you accept the actual size of the unit provided.
COST
  1. The Customer is responsible to pay:
     (a) The Storage Fee, being the amount set out on www.locitup.co.uk at the time of booking, or as otherwise agreed or most recently notified, payable monthly in advance on the Due Date. Payment must be made directly to Loc It Up on time and in full. Payment is not accepted until cleared funds are received.
    (b) A Cleaning Fee, to be invoiced at Loc It Up’s discretion in circumstances described in this agreement.
    (c) Any costs incurred by Loc It Up in collecting late or unpaid storage fees, or in enforcing this agreement, including postal, telephone, debt collection, personnel, default action costs, and legal fees.
    (d) Any applicable government taxes or VAT on supplies made under this agreement.
  2. Where the Customer has more than one agreement with Loc It Up, all agreements form one account, and Loc It Up may apply payments against the oldest debt due on any agreement.
DEFAULT – RIGHT TO SELL OR DISPOSE OF GOODS
  1. Loc It Up takes prompt payment seriously and has a right of lien. If any sum owing to Loc It Up is not paid when due, the Customer authorises Loc It Up without further notice to:
     (a) refuse access to the goods, unit, and facility and lock the unit until the debt is paid in full;
     (b) enter the unit and inspect and/or remove the goods to another unit or site, charging the Customer all reasonable costs of doing so;
     (c) apply additional charges and, if insufficient to clear the debt, sell or dispose of goods as outlined below.
  2. The Customer acknowledges that:
     (a) storage charges continue to accrue until payment is made or goods are sold;
     (b) Loc It Up will sell the goods as if it were the owner and transfer ownership to the buyer; and
     (c) if fees are not paid on time, any discounts or offers (including free storage periods) will be payable in full.
  3. On expiry or termination, if goods are not removed, Loc It Up is authorised to treat them as abandoned and may sell or dispose of them by any means. The Customer remains liable for fees from abandonment to sale or disposal.
  4. Before sale or disposal, Loc It Up will give written notice directing the Customer to pay or collect the goods. Notices will be sent by registered post or email to the last address provided. If the Customer fails to act within one month, Loc It Up will access the unit and proceed with sale or disposal.
  5. Sale proceeds will first cover removal and sale costs, then the debt. Any shortfall remains payable by the Customer within 7 days of written demand. Excess funds, if any, will be held for the Customer without interest.
  6. If goods are not saleable, fail to sell, or are of insufficient value, the Customer authorises Loc It Up to dispose of them at their cost. Loc It Up may also dispose of goods damaged by fire, flood, or other events that render them valueless or hazardous.
  7. Items left in common areas or outside the Customer’s unit may be moved, sold, or disposed of immediately without liability.
ACCESS
  1. The Customer has the right to access the unit during posted access hours. Loc It Up reserves the right to change access hours temporarily without prior notice.
  2. Only the Customer or authorised persons (Agents) may access the unit. Proof of identity may be required.
  3. Loc It Up may refuse access if money is owed or if safety or security is at risk.
  4. Customers allowing others access do so at their own risk.
  5. Loc It Up and its agents may enter the unit (and break locks if necessary):
     (a) with 7 days’ notice to inspect or repair;
     (b) without notice in emergencies or by lawful authority;
     (c) if prohibited goods are suspected;
     (d) to relocate goods, enforce a operator’s lien, or exercise rights of sale/disposal.
CONDITIONS
  1. Loc It Up is not responsible for locking any unlocked unit. Customers must ensure all gates and access points are secured after use.
  2. The Customer must not store:
  • (a) perishable goods unless sealed;
  • (b) living creatures;
  • (c) flammable substances (gas, petrol, paint, etc.);
  • (d) firearms, explosives, or ammunition;
  • (e) hazardous, toxic, or chemical materials;
  • (f) odorous or fume-emitting goods;
  • (g) illegal or counterfeit items;
  • (h) environmentally harmful goods; or
  • (i) irreplaceable or sentimental items (cash, jewellery, art, etc.).
     The Customer is liable for any breach of this clause.
  1. The unit must only be used for storage. Customers must not:
  • use it as accommodation or an office;
  • cause nuisance or odour;
  • invalidate insurance;
  • alter or attach fixtures;
  • connect utilities without permission;
  • damage or obstruct the facility.
  1. The unit must be kept clean and in good repair. Unclean or damaged units will incur a minimum £75 cleaning/repair fee, automatically charged to the Customer.
  2. Customers must act with care and respect on-site. Any obstruction, misuse, or unsafe behaviour will incur a £75 penalty and may result in immediate contract termination.
  3. Loc It Up may relocate customers to another unit (not smaller) with 14 days’ notice or sooner in emergencies. Loc It Up will pay reasonable removal costs if approved in writing beforehand.
  4. The Customer must ensure the unit is suitable for the goods and inspect it before and during use. Loc It Up offers no warranty on suitability.
  5. Loc It Up may refuse storage of any goods posing safety or legal risks.
  6. Customers must update Loc It Up within 48 hours of any change to contact details.
RISK AND RESPONSIBILITY
  1. Loc It Up will not be liable for loss or damages resulting from inability to access the facility, regardless of cause.
  2. Goods are stored at the Customer’s sole risk. Loc It Up’s total liability for loss or damage is limited to £100 per agreement. Loc It Up is not liable for business losses, indirect damage, or consequential loss.
  3. Loc It Up does not insure the goods. Customers must maintain insurance covering all normal perils for full replacement value at all times.
  4. The Customer is liable for and must indemnify Loc It Up for all claims, damages, and costs arising from use of the unit or breach of this agreement.
  5. Customers must comply with all applicable laws regarding storage. Liability for breach rests solely with the Customer.
  6. If Loc It Up suspects illegal or unsafe activity, it may cooperate with authorities, access the unit, and remove or dispose of goods immediately at the Customer’s expense.
  7. Loc It Up is not liable for failure to perform obligations caused by circumstances beyond its control (fire, flood, power failure, strikes, terrorism, etc.).
PERSONAL INFORMATION
  1. Loc It Up Limited processes customer data in line with the UK GDPR and Data Protection Act 2018.
    Data is used for account management, payment processing, security, and communication.
    Loc It Up may share data with credit agencies, insurers, or law enforcement where legally required.
    Customers may request a copy of their data by emailing info@locitup.co.uk.
  2. With your consent, Loc It Up may use your data for marketing, including updates about products or services that may interest you.
NOTICE
  1. Notices may be given by email, SMS, phone, hand, or pre-paid post.
     They are deemed received:
  • at time of delivery (hand),
  • one hour after sending (email/SMS),
  • or 48 hours after posting (mail).
     For joint customers, notice to one person is sufficient.
TERMINATION
  1. Either party may terminate this agreement by giving notice at any time.
     Upon termination, the Customer must vacate the unit by 11:00pm on the final day of their paid period and leave it clean and in good repair.
     Loc It Up may terminate immediately in cases of illegal activity, breach, or unpaid fees.
  2. The Customer must examine goods upon removal and report any loss or damage promptly.
  3. Liability for outstanding money or damage continues after termination.
GENERAL
  1. Loc It Up may vary fees or terms with 28 days’ written notice. Continued use after this period constitutes acceptance.
(a) This document forms the entire agreement.
 (b) Queries must be raised prior to entering this agreement.
 (c) Any waivers by Loc It Up must be in writing.
 (d) No third party has rights under this agreement.
 (e) Invalid clauses are severable.
 (f) Customers may not assign rights or sublet the unit.
 (g) Where there is more than one customer, obligations apply jointly and severally.
  1. This agreement is governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
    The parties agree to attempt mediation before court proceedings, except for emergency injunctions.
DIGITAL ACCEPTANCE
By completing the online sign-up and payment process, I/we confirm that:
  • I/we have read, understood, and accepted these Terms and Conditions;
  • I/we consent to receiving correspondence by SMS, email, post, or telephone;
  • I/we acknowledge that all key points have been drawn to my/our attention; and
  • I/we agree to be bound by the conditions of this Agreement with Loc It Up Limited.
